These Terms and Conditions ("Terms") govern your purchase of our products, including permanent canopies, carports, outdoor shelters, and related accessories (collectively, "Products"), and your use of our website. By placing an order with us or using our website, you agree to be bound by these Terms. Please read them carefully before making a purchase.
⚠️ Crucial Notice regarding Council Approvals: As outlined in Section 6, the Buyer is solely responsible for determining, obtaining, and complying with all local council approvals, development applications (DA), building permits, and engineering requirements before installing any Ready Canopy products.
1. Definitions and Interpretation
In these Terms, "we", "us", and "our" refer to Ready Canopy (and its registered business entity in Australia). "You", "your", "the Buyer", or "the Customer" refers to any person or entity purchasing our Products or accessing our website.
2. Ordering and Contract Formation

All orders placed through our website or via a custom quote constitute an offer to purchase, which is subject to acceptance by us.

A legally binding contract is formed only when we issue an order confirmation email and process your payment.

We reserve the right to decline or cancel any order (and refund any payments made) at our discretion, including due to product unavailability, errors in pricing or descriptions, or shipping limitations.
3. Pricing and Payment

All prices displayed on readycanopy.com.au are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless stated otherwise.

Shipping costs are calculated and added to the total before checkout, or provided as a separate quotation.

Full payment must be cleared before any order is dispatched or custom manufacturing commences.
4. Shipping, Delivery, and Risk

Delivery dates provided are estimates only. We are not liable for any delays caused by third-party freight carriers, custom clearances, or force majeure events.

Risk of loss or damage to the Products passes to you upon delivery to the specified shipping address.

It is your responsibility to inspect the packaging upon arrival and report any visible damage or missing components to us in writing within forty-eight (48) hours of receipt.
5. Returns, Refunds, and Consumer Guarantees

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Change of Mind: Due to the size, weight, and specialized engineering of our permanent canopies, we do not accept returns or offer refunds for change of mind. Please ensure you measure your space and verify specifications carefully before purchasing.

If a product is found to be defective, you must immediately cease use and notify us with photographic or video evidence.
6. Council Approvals, Permits, and Site Compliance
Our Products are engineered and designed to meet high standards of durability. However, compliance with local building regulations varies widely across regions:

Buyer Responsibility: You assume full and sole responsibility for verifying whether your installation requires a Development Application (DA), Complying Development Certificate (CDC), building permit, or any other approval from your local municipal council or private certifier.

Engineering Drawings: Ready Canopy provides standard structural drawings and material specifications. Any site-specific engineering certifications, localized wind rating assessments, or drafting required by your local authority are the sole financial and administrative responsibility of the Buyer.

Refund Exclusion: Ready Canopy will not issue refunds, accept returns, or cover any costs if your local council or authority refuses approval, orders the removal of a structure, or fines you for non-compliance.
7. Installation and Assembly

Ready Canopy is a supplier of high-quality flat-pack kits. Unless explicitly contracted in writing, installation and assembly are not included in the purchase price.

You must strictly follow the provided installation manuals and safety guides. We are not liable for any structural failures, property damage, or physical injuries resulting from incorrect assembly, poor site preparation, or the use of unqualified installers.

We strongly recommend employing licensed, insured, and experienced builders or tradespeople to assemble and anchor permanent structures.
8. Limitation of Liability
To the maximum extent permitted by law, Ready Canopy’s total liability for any claim arising out of or in connection with the purchase, delivery, or use of the Products shall be limited to the replacement of the Product or the refund of the purchase price paid. We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, property damage, or business interruption.
9. Intellectual Property
All content, designs, images, product specifications, and manuals on readycanopy.com.au are the intellectual property of Ready Canopy and are protected by Australian and international copyright laws. Any unauthorized reproduction or distribution is strictly prohibited.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales (NSW), Australia. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
